Love Advice No. 29

From the reader who asked a question via Search Box:

Pakikipagrelasyon sa 2nd cousin

My Answer:

Ayon sa batas (Republic Act No. 386):

Article 81. Marriages between the following are incestuous and void from their performance, whether the relationship between the parties be legitimate or illegitimate:

(1) Between ascendants and descendants of any degree;

(2) Between brothers and sisters, whether of the full or half blood;

(3) Between collateral relatives by blood within the fourth civil degree. (28a)

I recommend you to read this article while I discuss to you the following:

“Second cousins share great grandparents (magulang ng lolo/lola mo).”

(Two degrees apart kayo ng lola mo.)

Sinasabi sa batas na ang kasal ay walang bisa within the fourth civil degree (meaning, from first to fourth ay bawal). Gusto mo naman si Gloria. Nasa sixth civil degree naman siya. Puwede ba siyang ligawan? Yes, kung gusto mo. 🙂

I just want to point out that we now have Executive Order No. 209 or The Family Code of The Philippines. Under the said code, incestuous marriage as defined in Article 81 of R.A. 386 is now contained under Article 38 of The Family Code of the Philippines which states:

The following marriages shall be void from the beginning for reasons of public policy:

(1) Between collateral blood relatives, whether legitimate or illegitimate, up to the fourth civil degree; (relatives up to first cousins) xxxx

So, based on the provisions of the law, walang bawal kapag kinasal ka sa 2nd cousin mo. Except that medyo taboo lang dito sa Pinas.
